Trial for robbery delayed after new motion

HANCOCK COUNTY — A Greenfield man accused of robbing and beating his father has changed his mind about a speedy trial.

Michael E. Marvin, 40, faces a Level 3 felony charge of robbery resulting in bodily injury; a Level 3 felony count of burglary resulting in bodily injury; a Level 6 felony charge of strangulation; Class A misdemeanor charges of domestic battery and intimidation; and a Class B misdemeanor charge of criminal mischief.

The most serious charges each carry sentences of up to 16 years in prison.

Marvin originally pleaded not guilty on Oct. 7. Judge Terry Snow of Hancock County Superior Court 1 granted Marvin’s request for a speedy trial and appointed Chris Smith as his public defender, despite Marvin’s idea of representing himself.

On Friday, Nov. 22, however, Marvin withdrew his request for a speedy trial and is allowing Smith to represent him. The jury trial that had originally been set for Dec. 9 has now been moved back to Feb. 3, 2020.

According to a probable cause affidavit, the charges stem from a confrontation on Sept. 30 at a home in the 7200 block of Buck Creek Road.

The affidavit states Richard Marvin, Michael E. Marvin’s father, reported his son came over to pick up a blanket and $20. Richard Marvin says his son beat and choked him when he refused to give Michael Marvin more money.

Michael E. Marvin’s bond was set at $20,000 cash. He remains in the Hancock County Jail.
