Judge sets $50,000 bond in rape case

HANCOCK COUNTY — Sitting on a chair inside a room at the county jail, Adam Kincaid swayed back and forth waiting for his initial hearing to begin in Hancock County Superior Court 1.

Dressed in an orange jump suit and mask, Kincaid, 22, Indianapolis, faced Judge D.J. Davis via video on felony rape and sexual assault charges on Tuesday, Aug. 17.

The judge entered a not-guilty plea and set a $50,000 cash bond. Deputy prosecutor Jeffrey Wehmueller had asked for a $65,000 cash bond and told Davis Kincaid is on probation until October on an unrelated charge of operating a vehicle while intoxicated.

Kincaid, who is originally from New Palestine, had little to say during the hearing and answered “I’m not too sure,” when Davis asked him what he thought his bond should be. In addition to the bond, the judge also issued a no-contact order for the two women he is accused of assaulting.

Kincaid, a 2017 New Palestine High School graduate, has been accused of raping and sexually assaulting the women in June of 2018 while they were riding in the back seat of a car following a night of drinking at a party in the county.

While Wehmueller noted he would have preferred the higher bond, he was pleased to see Davis approve the no-contact order.

“That’s the important thing, to get the no-contact for the victims,” Wehmueller said. “We want to do everything we can to make sure they are protected in moving forward.”

Davis told Kincaid the order means he cannot have any type of contact with the women at all, including through social media while in jail or out on bond.

“No contact means nothing,” Davis said.

The judge set a pretrial conference for 9:30 a.m. Wednesday, Sept. 15.

Kincaid was still an inmate in the county jail at the Daily Reporter’s deadline on Tuesday, Aug. 17.
