Judge slightly lowers bond in rape case

HANCOCK COUNTY — A request for a smaller cash bond and placement in pretrial home detention for a man accused of rape were the topics of a hearing in Hancock County Superior Court 1 on Wednesday, Sept. 8.

Attorney Michael Boring, who is representing Adam Kincaid, 22, Indianapolis, on rape and sexual battery charges, asked Judge D.J. Davis to reduce Kincaid’s $50,000 cash bond to $2,500, saying the figure would be more appropriate.

Deputy prosecutor Jeffrey Wehmueller argued the higher bond should remain in place and called a detective from the Hancock County Sheriff’s Department as a witness. The detective said Kincaid is a figure in an investigation of another incident.

No other charges have been filed against Kincaid since his August arrest on charges stemming from an incident involving two women in June 2018. The women have accused Kincaid of rape and sexual battery. Regardless of any new investigation or other possible charges, Davis said he could not meet the defendant’s request for a $2,500 cash bond due to the severity of the existing charges.

“I know these are allegations, but these are serious crimes,” Davis said.

The judge did, however, lower the bond to $30,000 cash and said he’d consider home detention if it were available through Hancock County Community Corrections. However, court records stated Thursday, Sept. 9, that the judge, after consultation with community corrections officials, decided to deny the request for pretrial home detention.

Kincaid, a New Palestine High School graduate, is scheduled to have a pretrial conference at 9:30 a.m. Wednesday, Sept. 15. He was still listed as an inmate in the county jail as of the Daily Reporter’s deadline on Thursday.

According to court documents obtained by the Daily Reporter, Kincaid has been ordered to appear in Marion County Superior Court on Wednesday, Sept. 22, after a woman filed a petition to get an order of protection against Kincaid.
