Guerra-Posadas sentenced to 10-year term for dealing drugs

HANCOCK COUNTY — An out-of-state man accused of dealing methamphetamine and cocaine was sentenced last week in Hancock County Superior Court 1 following the acceptance of a plea agreement.

Gilberto Duvan Guerra-Posadas, 26, Germantown, Md., was facing a Level 2 felony count of dealing methamphetamine and a Level 2 felony count of dealing cocaine as well as a Class B misdemeanor charge of possession of marijuana after he and another man were caught with drugs along I-70 in March of 2022.

While the most serious charge carried up to 30 years in prison, Guerra-Posadas was sentenced to far less than that following the acceptance of the plea agreement.

According to the plea agreement, Guerra-Posadas had to admit guilt to the Level 2 felony count of dealing methamphetamine and was given a 10-year term with eight years to be executed at the Indiana Department of Corrections and two years suspended to probation. The other two charges against him were dropped.

Prosecutor Brent Eaton noted there are some issues pending for Guerra-Posadas in Maryland that will have to be addressed before he serves his sentence at the Indiana Department of Corrections. Eaton also noted Guerra-Posadas told officials, in his own words, that he expected to be deported long before he served any time anywhere in the United States.

According to a probable cause affidavit, Guerra-Posadas and another man, Axel Starlin Reyes-Garcia, 20, Silver Spring, Md., were arrested and charged after law enforcement found methamphetamine, cocaine and marijuana in a SUV they were driving after being pulled over on I-70 near mile-marker 108 in the county last spring.

Officials found a one kilogram brick package of contraband that field-tested positive for 2.5 pounds of cocaine and two other packages that totaled 2.1 pounds of a crystal-like substance that field-tested positive for methamphetamine, officials said in the report. The three large packages were found in the liner just inside the rear cargo door, officials said in the report.

Court records show the case against the other defendant, Reyes-Garcia, is still making it’s way through the judicial system with a pre-trial conference slated for early August.

In the meantime, Guerra-Posadas is still currently listed as an inmate in the Hancock County Jail.
