GREENFIELD — A Greenfield-Central teacher faces felony charges in Hamilton County after he was accused of falsely attesting to community service work done by a youthful offender from Fishers.
Brent Michael Oliver, 46, 2000 block of Justice Drive, Greenfield, was arrested by officers in Hamilton County on Wednesday, Jan. 1. He was charged with a Level 6 felony count of perjury and a Level 6 felony count of conspiracy to commit perjury. Each charge carries a maximum penalty of 2½ years in prison.
Greenfield-Central Superintendent Harold Olin said school officials were aware of the issues Oliver is now facing. Oliver formerly worked as an assistant principal at Greenfield-Central High School for five years and was reassigned to teaching duties after district officials became aware of his legal troubles. He is still an employee in the district, and officials do not plan to alter his status.
Olin released a statement late Monday, Jan. 6, that said the school board on Oct. 21 accepted Oliver’s resignation as an assistant principal at Greenfield-Central High School. They then accepted a recommendation to hire Oliver as an English/language arts teacher.
“As it is a personnel matter, I cannot comment further,” Olin said in the news release.
According to a probable cause affidavit from the Hamilton County prosecutor’s office, on Sept. 9, Luis Daniel Vazquez, 19, Fishers, presented a verification form to Hamilton County officials indicating he had done court-supervised community service work in Greenfield during the summer of 2019.
The form completed by Vazquez had a verification signature from Oliver, who signed it as a representative of Greenfield-Central High School. The form was dated Sept. 6, 2019. The paperwork stated Vazquez performed community service work hours on Saturday, Aug. 24; and Sunday, Aug. 25.
District officials do not have any type of arrangement with Hamilton County for such a pre-trial diversion program, Olin said. Oliver signed the paperwork on his own without Greenfield-Central’s knowledge, Olin said.
Officials from Hamilton County later determined Vazquez did not perform any type of community service in Greenfield, the affidavit said.
It is not clear from the affidavit how Vazquez and Oliver know each other or how they agreed to get Oliver to sign the paperwork. Both men refused to speak with investigators during their inquiry in November, the affidavit noted.
In conversations with G-C personnel in late September, Oliver acknowledged signing the document and that he did so knowing the community service hours had not been performed, the affidavit said.
Oliver’s signature follows language that stated, “I affirm to the Prosecuting Attorney for Hamilton County, under the pains and penalties of perjury as specified by I.C. 35-44. 1-2-1, that the following representations are true. I authorized the individuals whose signatures are affixed above and who are employees of this organization to supervise the volunteer on the dates and times recorded above.”
The report shows Vazquez lives in Hamilton County and that cellphone records obtained via a search warrant established Vazquez’s cell phone did not go Greenfield on the days he was supposed to have done community service work.
According to court records in Hamilton County, Vazquez was charged in February 2019 with a Class C misdemeanor for reckless driving and received a 60-day sentence. He has since been charged with a Level 6 felony count of conspiracy to commit perjury due to the issue with Oliver.
According to Hamilton County Superior Court 6 records, the case against Oliver was officially opened Dec. 31, and a warrant for Oliver’s arrest was issued Jan. 1. Oliver made his first appearance in court on Jan. 2.
