Man sentenced for 2017 crash that injured 2

HANCOCK COUNTY — A Morgan County man who was accused of driving while impaired and causing a two-car accident that sent two people to the hospital with serious injuries was sentenced Thursday in Hancock County Circuit Court.

Donnie L. Disney, 37, was given two four-year sentences by Judge Scott Sirk to run at the same time. Disney will serve the time through community corrections.

In a plea agreement, Disney pleaded guilty to two Level 5 felony charges of causing serious injury while operating a motor vehicle. Three other charges were dropped.

According to court documents, in September 2017, Disney was the cause of a two-car accident in which two people, Monte Montgomery and Cynthia Montgomery, suffered serious injuries. The accident occurred at County Roads 700W and 300N.

Charges were filed against Disney in December 2017 after results from his blood work came back indicating he was intoxicated at the time of the crash. The toxicology analysis showed Disney was under the influence of numerous drugs, including, alprazolam, diazepam, nordiazepam, THC, marijuana, oxycodone and oxymorphone.

Monte Montgomery told officials he was in the hospital for five days with injuries to his head. He suffered loss of hearing, loss of smell and loss of taste. Cynthia Montgomery told officials she was in the hospital for four days with head, nose and eye issues. Both were treated by a neurologist to deal with their injuries.

Before handing down the sentence, Sirk told Disney he would accept the plea deal, but he wanted Disney to know the victims in the accident are fine people who were affected by Disney’s decision to drive while impaired.

Probation officer Mary K. Dobbs said both victims agreed to the plea agreement and that if Disney violates his sentence in any way, he will have to serve the four years in prison.
