GREENFIELD — A Greenfield man will serve time on probation after admitting to half of the sexual assault-related charges that were filed against him.
Jade Kincade, 20, 8426 N. State St., was arrested late last year amid allegations he had an inappropriate relationship with an underage girl, according to court documents.
This week, he was sentenced to serve time — a year and six months on probation after admitting to sexual misconduct with a minor and criminal recklessness with a deadly weapon.
The girl told police she met Kincade for sex on three different occasions when she was younger than 16 — the legal age of consent in Indiana, according to charging documents. Kincade was 19 at the time, officials said.
After one encounter, Kincade pointed a gun at the victim’s young friend when she became upset about the pair’s relationship, according to court documents.
In an interview with police, Kincade admitted to having sex with the girl, but he said he thought she was older, according to court documents. She’d told him she was 17, Kincade told investigators, according to court documents. Once he’d learned her real age, he cut off contact with her, court documents state.
Kincade originally faced three Level 5 felony counts of sexual misconduct with a minor and one Level 6 felony count of criminal recklessness committed with a deadly weapon.
The plea agreement he accepted from prosecutors this week dropped the single count of misconduct he pleaded guilty to from Level 5 felony, as originally charged, to a lesser Level 6 felony, records show.
The remaining two counts of the sexual misconduct were dismissed, records show.
Kincade pleaded guilty to the one Level 6 felony count of criminal recklessness committed with a deadly weapon that was filed against him, records show.
The victim told police she first met Kincade in October 2017 during Greenfield’s annual Riley Festival, court documents state. They exchanged text messages in the day that followed, and eventually, their relationship became sexual.
The sentence Kincade was ordered to serve amounts to 545 days, records show. He served two days in jail right after his arrest.
