CHARLOTTESVILLE — A senior at Eastern Hancock High School faces felony charges after he was caught having sex with an underage classmate in a restroom during school, according to court records.
Eighteen-year-old Samson Livingston of New Palestine faces three felony counts of sexual misconduct with a minor, each alleging he had an inappropriate encounter with a younger student at school earlier this month, court documents state.
Investigators say the other student involved is 15 years old — too young by law to consent to a sexual relationship with Livingston, who is legally an adult.
Earlier this month, two Eastern Hancock High School students told a teacher they’d heard a pair of classmates having sex in a girl’s restroom at the high school, court documents said.
The teacher immediately notified school administrators, but found there was no one in the bathroom when she went to investigate, court documents state.
The school’s vice principal and a Hancock County sheriff’s deputy who was working as a school resource officer that day checked hallway security cameras in hopes of identifying the students involved.
They spotted Livingston and a female student entering the girl’s bathroom together around the time of the alleged incident, court documents state.
Livingston and the other student were then brought to the office, and investigators from the sheriff’s department and the Indiana Department of Child Services were notified, Principal David Pfaff said in a letter sent to parents last week.
Detectives from the sheriff’s department interviewed the girl a day after the incident.
She said she and Livingston were friends, and Livingston began texting her about having sex just 10 minutes before their encounter, court documents state.
The girl said Livingston asked her to meet him in the girl’s restroom that day, and she agreed, court documents state.
Investigated examined the girl’s cellphone and found text messages in which Livingston asked her to send him inappropriate photos of herself, according to police reports.
Prosecutors filed three Level 5 felony counts of sexual misconduct with a minor against Livingston this week, court records show.
