Rape suspect transferred to Marion County Jail, initial hearing slated for next week

HANCOCK COUNTY — Adam Kincaid was ordered released from the Hancock County jail earlier this week after his rape trial was delayed. He is now sitting in the Marion County jail under a $120,000 surety bond. Kincaid is set to make an initial appearance in a Marion County court next week to face rape and confinement charges there.

Kincaid, 24, Indianapolis, was officially transferred to the Marion County Jail on Wednesday, April 27 after an order from Hancock County Superior Court 1 called for his immediate release and subsequent dismissal of a $30,000 cash bond, that was once set at $50,000, for rape charges in Hancock County.

Kincaid did pay a $1,000 cash bond in Hancock County for a separate misdemeanor charge surrounding a probation violation before being transferred to Marion County. Charges were filed against him there in October, 2021 from an incident in March of 2021 when he was in the Hancock County jail awaiting trial.

He’s scheduled to appear at 9:30 a.m. Monday, May 2 in Marion County Superior Court 31 to face a Level 3 felony charge of rape and a Level 5 felony charge of confinement. During his initial hearing, Kincaid will be allowed to enter a guilty or not guilty plea and be assigned court dates.

Kincaid is currently facing a surety bond on his initial hold in Marion County. He’ll have to come up with at least 10% of the $120,000, in his case, $12,000 cash and/or property to ensure he attends all required court appearances. If Kincaid can not produce the money, he’ll remain in jail.

Kincaid is a 2017 New Palestine High School graduate whose attorney secured his release locally when the rape trial here, from an incident in June, 2018, was pushed until next month. The court released since Kincaid who had been in the local county jail since August, 2021 when he was first arrested.

Despite the court order, the rape trial against Kincaid here is set for Tuesday, May 24. His lawyer in the local case, Christopher Taylor, a New Palestine attorney, said he believes in his client.

“Adam Kincaid is adamant that he is innocent and that the charges against him are entirely unfounded,” Taylor said in an email to the Daily Reporter.

Taylor went on to say the local county charges are based solely on the recollections of two young women who, by their own admission, were intoxicated on the night in question and did not report to police until more than three years after the events of that evening.

“We firmly believe that when a jury of Adam’s peers hears the full story of what actually happened on this brief car ride that occurred in the midst of a party among friends, they will have no difficulty finding Adam not guilty and acquitting him of all charges,” Taylor said. “Adam looks forward to having his day in court and to having his name and reputation cleared.”

Taylor noted his law firm has not been hired to represent Kincaid in the Marion County case. Marion County Jail records show Kincaid is still listed as an inmate as of late Thursday afternoon.
