Another woman accuses suspect of sexual assault

HANCOCK COUNTY — An Indianapolis man already sitting in the Hancock County Jail on rape charges has been accused of another sexual assault in Marion County.

A warrant was issued Tuesday, Oct. 5, for Adam Kincaid, 23, stemming from an incident in March 2020.

The woman in the newest case has ties to Hancock County and came forward after Kincaid was arrested on two counts of rape Aug. 16, an affidavit stated.

In the Marion County case, Kincaid has been charged with a Level 3 felony count of rape and a Level 5 felony count of criminal confinement with bodily injury. The case was opened earlier this week and assigned to Marion Superior Court 31. The most serious charge against Kincaid carries a sentence of up to 16 years in prison.

According to a probable cause affidavit filed by the Marion County prosecutor’s office, the woman, who stated she had known Kincaid since elementary school, received a call from him on March 26, 2020, asking for a ride because he was drunk and didn’t have a license. She agreed to pick him up, the affidavit said.

The woman took Kincaid to her house because he lived on the west side of Indianapolis and she didn’t want to drive there, the report stated.

The woman told investigators she had a previous relationship with Kincaid, but that he had a girlfriend at the time. She made him agree nothing would happen between them before she picked him up, she stated in the affidavit.

When the two got back to the woman’s home, Kincaid started kissing her and she hit him to get him to stop, but he wouldn’t, the affidavit said. The woman said Kincaid sexually assaulted her even as she kept telling him “no.”

The woman told investigators she was assaulted again as she tried to get him to leave. The two eventually got into her car so she could take him back to where she had picked him up; during the trip, Kincaid tried to force himself on her again, the affidavit said.

Kincaid had no memory of what had happened until she told him the next morning, the affidavit said.

The woman said she learned from family members about an alleged incident in April that occurred involving Kincaid and another female in their friend group at a party. After learning about Kincaid’s arrest for the rape charges in Hancock County, the woman said family reached out to her to see if Kincaid had ever harmed her, and she finally told her family what Kincaid had done, the affidavit said.

The victim stated she waited so long to contact police because Kincaid had been a friend since childhood, and it wasn’t until after he was arrested that she felt safe enough to come forward, the affidavit said.

Kincaid is being held in the Hancock County Jail under a $30,000 cash bond. He has a pretrial conference set for charges here on Nov. 3.
