Jury convicts Billings man of murder for shooting another man to death during argument

BILLINGS, Montana — A jury has convicted a Billings man of shooting another man to death during an argument in April.

The Billings Gazette reports (http://goo.gl/saJkXM ) jurors deliberated for eight hours before finding 33-year-old Joseph Richard Polak II guilty of deliberate homicide, tampering with evidence and criminal endangerment in the April 28 death of 29-year-old Scott Marshall Hofferber.

According to court records, Polak and Hofferber had planned to fight each other, but as Hofferber handed Polak a nail puller, Polak pulled out a gun and shot Hofferber in the chest.

Polak's attorneys argued their client was acting in self-defense.

The tampering and criminal endangerment charges were brought because Polak disposed of the handgun and resisted officers during his arrest.
