WHITE PLAINS, New York — An officer at a women's prison in New York has been charged with rape for allegedly having sex with an inmate.

State police and the Westchester County district attorney said Tuesday that Richard Rodriguez of Brooklyn was arraigned in Bedford Town Court on a charge of third-degree rape.

They said Rodriguez, who worked at the Bedford Hills Correctional Facility, engaged in sex with the inmate on Dec. 23. An investigation began in February and Rodriguez was suspended without pay in March.

He surrendered to state police on Monday.

A call to Rodriguez's lawyer was not immediately returned.

Under state law, an inmate's consent is not a defense in cases of sex between an inmate and a prison guard.

If convicted, Rodriguez would face up to four years in prison.
