AUSTIN, Texas — A Travis County grand jury has declined to indict four police officers who last year fatally shot an armed man at his Austin home.

The officers were cleared Tuesday in the death of 54-year-old Herbert Babelay, who was shot multiple times in April 2013. The jurors reached the decision after 11 hours of testimony.

Babelay's brother called authorities and said he was concerned for his brother, who was suffering from a mental illness. He told the 911 operator Babelay was a danger to himself and others.

The four officers say Babely barricaded himself in a shed with a gun before pointing the weapon at them.

The officers were placed on administrative leave after the shooting but later returned to regular duty.
