BILLINGS, Montana — A 43-year-old Billings man who was charged with deliberate homicide in August still doesn't have an attorney.
Patrick O. Neiss III is charged with the March 2013 death of his neighbor, 47-year-old Frank Greene III.
The Billings Gazette reports (http://bit.ly/14RVUR6 ) District Judge Mary Jane Knisely on Dec. 29 ordered the state public defender's office to assign an attorney for Neiss, whose trial is set for Feb. 24.
The public defenders' office had twice determined Neiss didn't qualify financially.
David Duke with the public defender's office in Billings said attorneys in his office have represented or are representing some of the witnesses in the case against Neiss.
Tom Bartleson with the state public defender's office in Helena said Monday that Neiss will be assigned an attorney, but no one had been assigned yet.
Neiss is jailed with his bond set at $500,000.
