Ohio mom loses appeal over maximum prison sentence in son's abuse death last year

SANDUSKY, Ohio — A northern Ohio mother who was sentenced to 11 years in prison for allowing her boyfriend to fatally abuse her 3-year-old son has lost an appeal.

The 6th Ohio District Court of Appeals on Wednesday rejected 24-year-old Danielle Flannery's argument that the trial court should not have sentenced her to the maximum sentence for the crime of permitting child abuse.

She pleaded guilty to the charge and was sentenced last year in Erie County Common Pleas Court in Sandusky.

Flannery's 3-year-old son died on July 30, 2012, while in the care of her then-boyfriend Michael Milner.

Police allege Milner delivered the fatal blows that resulted in the boy's death. He was sentenced to life in prison without parole last August. His appeal is pending.
