Records: Judge orders drunk man to jail

HANCOCK COUNTY — A Martinsville man was drunk when he came to court to plead guilty to the drunken-driving charges he faced, so he is now serving a seven-day jail sentence after a judge found him guilty of contempt, records show.

John Wesley Carter II, 40, 1430 Columbus St., had a blood-alcohol content more than four times the legal limit of .08 when he came to Hancock County Superior Court 2 Monday morning, according to court records.

Carter was scheduled to appear for a change of plea hearing in a misdemeanor-level criminal case, in which he faces charges of operating while intoxicated and unsafe lane movement, records state. The case was filed in February.

Court security officers smelled alcohol on Carter’s breath, officials said. A breath test showed he had a blood-alcohol content of .304 percent, court records state. He’d been driven to court by a relative, officials said.

Judge Dan Marshall found the man guilty of contempt of court and ordered he serve seven days in the Hancock County Jail.

Carter is scheduled to return to court Monday for a new change of plea hearing, records show.
